Terms of Service

By signing this agreement, you ("Client") agree to retain Jacqui Smith of WhiteSpace Design Studio. ("Service Provider") to proceed with an appointment to enquire of business services, packaged under Connect Call, and agree to the terms and conditions as set forth in this Agreement. 

Timeline : Work will be performed at the offices of Service Provider, but occasionally may take place at other locations, as required. Work priority and scheduling will be at the discretion of Client. Work will normally occur between the hours of 7:30am - 11:30am AEST on selected weekdays.

Scope : During this appointment, Service Provider agrees to devote up to 20 minutes answering questions to be determined by Client, including a follow up email outlining the outcome of the discussion and details of requested business services. The Client is responsible for implementing the outcomes themselves, with their team or they can hire the Service Provider. 

Payment Schedule : There is no payment due for these services at the time of booking this appointment.

Additional Work : Design or coaching services in outcome of the call will be made available by Service Provider at the current rate, and will be billed separately. Any expenses exclusive of normal overhead are not included in this agreement and will be billed separately. Examples of such expenses are: stock images, premium font licenses, website domain, hosting and plugins, and 3rd party application services.

The client is responsible for providing their own typography license for any fonts used, all content, including copy and digital photos and images unless otherwise specified in the project scope. Guidance is offered when needed, the final content is to be supplied by the Client. The additional work can be provided by the Service Provider at an additional cost to the Client.

Ownership : The results of any and all work performed by Service Provider for Client are owned by the Service Provider. Client may use this material in any way deemed appropriate. Copyright to client supplied text and images are retained by Client and will not be disclosed or reused by Service Provider unless permission is granted in writing. Copyright to scripts, coding or other elements not created by the Service Provider are retained by the respective owner.

Client understands that any written statements, images, audio recordings or video recordings of Client while participating in the appointment and made on behalf of the Service Provider may be used in connection with publicising and promoting the Service Provider. Client authorises the Service Provider to use their name, brief biographical information, and the written or recorded statements. Client agrees that the Service Provider can include site credit with external link on the bottom of the website pages. The Client also agrees to allow the Service Provider to include the project in the Service Provider's portfolio and marketing materials.

Limited Liability : Client agrees that any material submitted for publication will not contain anything leading to an abusive or unethical use of the Web Hosting Service, the Host Server or the Developer. Abusive and unethical materials and uses include, but are not limited to, pornography, obscenity, nudity, violations of privacy, computer viruses, harassment, any illegal activity, spamming, advocacy of an illegal activity, and any infringement of privacy. Client hereby agrees to indemnify and hold harmless the Service Provider from any claim resulting from the Client's publication of material or use of those materials. It is also understood that the Service Provider will not publish information over the Internet which may be used by another party to harm another. The Service Provider reserves the right to choose whom they work with.

Modification : The client has the right to modify the outcome after the appointment is complete at the risk of damages to functionality or design. If modifications are made to the outcome after completion and service is needed from the Service Provider the Client must book an additional VIP Fresh Session, VIP Design Day to cover the fixes.
